Position overview
Judicial Registrars support Judges in facilitating the just resolution of general federal law proceedings as quickly, inexpensively and efficiently as possible and play a key role in achieving the Court’s objectives by:

• Performing delegated judicial functions at a high level from the bench;
• Conducting mediations;
• Supporting the development and implementation of the Court’s policies and practices;
• Contributing to the development of practice area resources; and
• Liaising with Judges, court staff, court users and other internal and external stakeholders.

The Court is committed to supporting the professional development of all its staff and providing a career pathway within the Court. Judicial Registrars with suitable experience may be considered for national leadership roles. The Court also has an extraordinary track record of judicial appointments being made from the ranks of its Registrars. Although primarily focused on general federal law matters, the position may also involve undertaking Judicial Registrar work in migration law matters.

Key responsibilities and duties

Delegated judicial functions

• Exercising delegated judicial powers and functions pursuant to section 254 of the Federal Circuit and Family Court of Australia Act 2021 (Cth) and other legislative instruments to:
  • Hear and determine general and personal insolvency proceedings under the Bankruptcy Act 1966 (Cth), including creditor’s petitions, applications to set aside Bankruptcy Notices, applications to administer deceased estates and applications for substituted service orders.
  • Hear and determine small claims under the Fair Work Act 2009 (Cth) and the National Consumer Credit Protection Act 2009 (Cth).
  • Hear and determine certain interlocutory applications, including applications for summary judgment, costs, discovery and subpoena objections.
  • Conduct public examinations in bankruptcy. 

Case management and alternative dispute resolution

• Conducting case management hearings including directions hearings and callovers in general federal law proceedings including adverse action, human rights and Fair Work matters and providing other case management support to Judges as required.
• Conducting mediations and other alternative dispute resolution events.
• Performing urgent and duty registrar work in relation to general federal law matters, as required.

Policy and practice and leadership

• Contributing to the development and improvement of policies, processes and practice resources.
• Contributing to professional development opportunities for Judges, Registrars, Court staff and members of the profession. 

Professional qualifications, competencies and attributes
This position requires the performance of statutory legal functions. These functions include conducting hearings (including case management hearings) and mediations. Legal qualifications and admission to the legal profession in an Australian jurisdiction is essential.

This role is suitable for lawyers at senior associate level or above with substantial civil litigation experience. A minimum of 5 years’ post-admission experience is expected.  

The successful applicant will be expected to be willing to undertake the necessary course and assessment modules to obtain accreditation, as arranged by the Court (unless they are already an accredited mediator).  Applicants who are accredited as a mediator, or experience in conducting or participating in mediations, will be considered favourably.  For suitable applicants, the Court will consider candidates who presently do not reside in Perth but are willing to relocate.

Selection criteria

1. Considerable experience in civil litigation and practice.  
2. The ability to preside in court and exercise delegated judicial powers and functions.
3. Demonstrated experience in, or the ability to conduct, mediations or other ADR processes.
4. Demonstrated experience and understanding of the jurisdiction and practice of the Court in one ort more areas of general federal law.
5. Excellent analytical skills and demonstrated ability to critically evaluate large volumes of information and demonstrate sound judgment in decision-making in a high-pressure environment.
6. Highly developed communication skills, including the ability to represent the Court at a senior level, when interacting with the public and legal profession, and the ability to influence behaviour and attitudes at all levels.
7. Demonstrated ability to shape strategic thinking and implement improved and innovative practices.
8. Demonstrated proficiency with technology, including the use of electronic legal resources and the ability to learn and use the Court’s case management systems and courtroom technology. 
9. Demonstrated understanding and commitment to the application of the Australian Public Service (APS) values, to abide by the APS Code of Conduct and the ability to comply with the principles of Workplace Diversity and Occupational Health and Safety.

Eligibility
Employment with the Court is subject to the conditions prescribed in the Public Service Act 1999, and the following:

1. Australian citizenship – the successful applicant must hold Australian citizenship.
2. Security and character clearance – the successful applicant must satisfy a Police Records Check and may also be required to complete security clearances during the course of their employment.
3. Successful applicants will be subject to a probation period.
