Prosecutor

We are seeking a skilled Prosecutor to join our team on a parental leave contract from 7 September 2026 to 30 July 2027 (inclusive).

In this role, you will provide high-quality prosecution services that support improved safety and regulatory compliance outcomes across the heavy vehicle industry. You will work on a diverse range of matters, applying your legal expertise to contribute to safer roads and a stronger regulatory framework.

About the role

• Preparing formatters listed in Courts of Summary Jurisdiction of various States and Territories of Australia, with a focus on Victoria, South Australia and Tasmania.
• Appearing in the Courts of Summary jurisdiction and occasional County/District Court hearings, as required.
• Research, analyse and make determinations on briefs of evidence and court elected expiation notices relating to breaches of the Heavy Vehicle National Law, while ensuring that legislative and policy considerations are appropriately applied.
• Assess the sufficiency of evidence contained in briefs and identify the correct charges to be preferred in accordance with the Prosecutions Policy of the NHVR.
• Draft documents, such as charges/information and summaries of facts in relation to breaches of the Heavy Vehicle National Law, Regulations and State Road legislation, while ensuring that legislative and policy considerations are applied.
• Develop and maintain an active working knowledge of legal constraints and precedents relating to matters of law which could influence proceedings for breaches of the Heavy Vehicle National Law and Regulations.
• Work effectively, either individually or as part of a team, with an emphasis on meeting deadlines within quality, cost and time constraints.
• Provide sound options or recommendations to internal and external stakeholders.
• Draft complex correspondence, reports, legal analyses and submissions in accordance with agency standards.
• Actively seek and participate in personal development as well as offer support and guidance to fellow team members.
• Consult, liaise and maintain effective relationships with internal and external stakeholders.
• Compliance with the requirements of the Australian Solicitors Conduct Rules.

About You

• Demonstrated experience and competence in the field of prosecutions including all facets of court preparations and working with court procedures, summary procedures and the Magistrates Court and/or County/District Court legislation, including the interpretation and presentation of expert evidence.
• Proven high level level interpersonal and communications skills including an ability to liaise effectively with staff, prosecutors, witnesses, police, counsel, members of the public and other prosecuting and investigating authorities and to deal tactfully and confidently with confidential issues at a high level.
• Demonstrated capacity to work effectively and creatively under limited direction, either independently or in a team.
• Demonstrated ability to plan and co-ordinate high volumes of work, develop new procedures and alternative solutions to problems, set and meet deadlines.
• Ability to acquire knowledge and learn new skills in short time-frames
• Personal commitment to maintaining ethical standards within a prosecuting framework.

Essential to the Role

• Hold a Degree in Law and be admitted or be eligible to be admitted as a Legal Practitioner in the Supreme Court of a State or Territory of Australia.
• The incumbent is expected to handle confidential and sensitive material and adhere to all relevant guidelines in relation to confidentiality, disclosure of information, impartiality and conflict of interest.
• Some out of hours work and intrastate and interstate travel necessitating overnight absences will be required.
• A current unrestricted driver’s licence is essential.

Highly Regarded:

• Experience in a State, Commonwealth or regulatory prosecuting office, preferably in
• Victoria, South Australia or Tasmania.
• Familiarity with Victorian, South Australian or Tasmanian criminal procedure.
• Experience in the conduct of criminal proceedings relating to regulation, breaches of a
• Work, Health and Safety Act, or other similar Acts.
• Advocacy experience in a State Magistrates’ Court or similar.
